Eligibility conditions

1. Eligible funding applicants are represented by local public authorities from the North-East Development Region - Territorial Administrative Units of commune type.

2. The applicant and/ or his/ her legal representative does not fall under the exclusion situations presented in the Single Declaration - Annex 3.

3. The applicant must demonstrate at least one of the following rights (which would allow him to obtain a building permit) over the property that is the subject of the project:

   • public property right,

   • administration right,

   • concession right.

4. The provisional registration of the ownership right/ right of administration mentioned in this section is not accepted.

5. The project has not benefited from public funding, for the same costs related to the same eligible activities as follows:

   • projects without works started – 5 years before the date of submission of the application for funding and do not benefit from public funds from other sources of funding, other than those of the applicant,

   • projects with works started – 5 years before the date of issuance of the order to start the works contract for the same and cost related to the same type of activities, was not in the guarantee period for the activities and does not benefit from public funds from other sources of funding, other than those of the applicant.

6. The project must not be physically completed or fully implemented before the submission of the application for funding under the North-East Regional Policy 2021-2027, regardless of whether all related payments have been made by the beneficiary or not.

7. The implementation period of the project activities must not exceed 31 December 2029.

8. The place of implementation of the project is located in the communes of the North-East Development Region.

9. The project complies with the provisions of community and national legislation in the field of sustainable development, equal opportunities and non-discrimination, gender equality and accessibility for people with disabilities.

10. The project includes ESF+ type measures to combat school segregation and social exclusion, if these have been identified in the Self-Assessment of the educational unit.

11. The project is part of a territorial/local development strategy.

12. The project has obtained the Investment Opportunity Notice issued by the Ministry of Education.

13. In the case of the creation of new educational units (except for nurseries and kindergartens), the demographic trend at the ATU level (between 2018 and 2022) is positive.

14. In the case of the expansion of an educational unit, it is affected by the phenomenon of school overcrowding.

15. The project complies with the requirements regarding the immunization of infrastructure against climate change.

16. The project complies with the DNSH principle - which does not significantly harm environmental objectives.

17. The project does not fall under the scope of state aid or no elements of a state aid nature are identified within it.

Eligible expenses

Eligible expenses are:

Direct costs:

1. Services:

   • expenses for ESF+ type measures addressing desegregation and social inclusion (eligible up to a maximum of 5% of the eligible value of the project),

   • expenses for the digitization of units: digital communication and document exchange platforms, databases, virtual libraries, etc.

2. Works:

   • land development,

   • expenses for environmental protection and restoration,

   • expenses for the relocation/ protection of utilities,

   • expenses for ensuring the utilities necessary for the operation of the investment objective,

   • constructions and installations,

   • constructions and installations - consolidation, within a maximum percentage of 40% of the eligible value of the project,

   • assembly of machinery, technological and functional equipment,

   • machinery, technological and functional equipment requiring assembly,

   • expenses for the location of electric charging stations and points,

   • construction works and installations related to the organization of the construction site,

   • expenses related to the organization of the construction site,

   • miscellaneous and unforeseen expenses.

3. Equipment/ Facilities/ Tangible Assets:

   • land acquisition within the limit of 10% of the total eligible value of the project,

   • expenses for the acquisition of machinery, technological and functional equipment that does not require assembly and transport equipment (electric school transport vehicles),

   • facilities.

4. Expenses with intangible assets.

5. Implementation reserve:

   • expenses for the establishment of the implementation reserve for price adjustment.

Indirect costs:

• Expenses in the form of flat-rate payments of a maximum of 7% of the value of eligible direct costs:

  • information and advertising activities,

  • consultancy services for the preparation of financing documentation and consultancy services in the field of project management,

  • financial audit services,

  • consultancy services regarding the organization of procurement procedures,

  • geotechnical, geological, hydrological, hydrogeotechnical, photogrammetric, topographic, land stability studies,

  • support documentation and obtaining approvals, agreements, authorizations,

  • technical expertise of existing constructions,

  • energy performance certification and energy audit of buildings,

  • design expenses,

  • technical assistance from the designer,

  • technical assistance from the site supervisors,

  • expenses for commissions, quotas, taxes.
